I told the Attorney, we are waiting for a couple more people to acknowledge they are going to join us in the petition. He will be filing the suit next week. I am planning on meeting him in Delaware soon and personally make sure we are all on the same page. He explained to me that we the petitioners will have to sign a document for the court and it will be notarized. It will be one day to file the paperwork and then we can get the court to subpoena docs and get the shareholder list. I am looking forward to taking statements from witnesses, GR, MV and others. Kathy Singh is one I know has knowledge of Valuation along with Ted Myles. I am pretty confident with my last trip to Korea, Astellas doesn't want to get tied up with spending money or time on this suit and wants to move on quickly. We will prevail. IMHO
As of this date, nothing has been filed and you will receive 8.50 if you didn't request appraisal rights.

Im working on it. Things are one step at a time, and we are still getting our troops together, soon as possible we will file. Then again, the attorneys schedule and courts schedule will take place. Everything is moving in the right direction. Ill keep you informed.

Is the deadline for filing (and joining the other suit) March 31st, tomorrow? And has anyone had any success in getting some of their shares split off (to sell) but keeping the bulk in the appraisal process? I've been asleep at the wheel on this - and if the deadline is upon us, I need to move fast ...

I had the position on multiple accounts, so I sold from different ones and kept bulk but did not have to split. Send a personal note to kukkido on timeline / onboarding to suit if you want.

Right after I posted that query I checked my Fidelity account and the OCAT position had been zeroed out. Since I reserved rights I'm guessing they've gone into that 'batch'. I put a call into to a specialist at Fidelity that Churchmaus dealt with, waiting to hear back from her. As for joining the suit, it boils down to whether Fidelity will allow some my shares to be split off or not.

Eric the attorney can split your shares. You just have to be persistent with the Bank. The law allows for you to split its just a lot more work from the bank to cancel and reissue the stock certificates. Its possible. But, MM we need your shares to qualify for our 25% retainer fee.
Kukkido. Let me know if you need some help on this. I went through the process with Scottrade its almost the same with Fidelity.

Hi John,
I just received from Eric the engagement letter which I will sign and return to him today. I just tried phoning his office but our phone lines here in Mozambique are having some issues; i'll try him again a bit later. Meanwhile, I notice that we have to pay certain charges. Will we have to pay these before the suit is resolved, and did he give you a rough idea of how much it might run?
As for splitting off some (not more than 2000 of the 12,000 total), the guy at Fidelity had a bit of a screw-you attitude and said 'the stock is no longer trading so there's no way you can sell any of your shares, period. Any comments on that? If we're talking one year I can do without selling any. My main concern is having to pay out of pocket while the case is underway.
Any chance we could communicate in the future by email? Mfmoye@gmail.com is mine and i access it constantly.
Has Eric given you a sense of what we might see at the end of the road. A double ($17) or more?

Kukkido, Fidelity said that they can't split of any shares, and even if they could, the stock isn't trading any longer. And suggestions on how to proceed? I can probably do without splitting off shares provided we incur no out of pocket expenses from Eric (hiring the appraisers etc) before the case is settled. Now I'm just waiting for Eric to send me the "Cede letter" to sign - I already have the agreement w/ Eric's firm.... cheers

The shares I had fidelity liquidate (by retracting my dissenting rights) where changed to a CUSIP pending to be liquidated at $8.50. They said this process would take weeks and it is. Again mine was simpler since I sold small amount of shares from a separate account. If you tell them "I retract my dissenting rights on 2000 shares out of 12000" in theory they should be able to figure out what to do. They might come back with a cost to do so, but in my case it was all free.
Kukkido will be the best person to explain any costs prior to case settlement and how we might want to handle as a group. I hope they are low as well.
Timing wise this case might be settled out of court this year, but if we fight it out I understand average timelines might go to 3 years. Based on history provided here earlier, similar cases did achieve better pricing by a little or a lot. OCAT in my mind has the potential to be a lot and I hope we settled for what it is really worth.

Hi, Eric the attorney is the BEST person to ask anything pertaining to the petition. Please talk to him about any concerns you have. As far as retracting shares, you should be able to have fidelity handle that, it will just take longer to get your money than if you had initially tendered. There is no trading involved, just tendering.

Welcome aboard! jak Jak, thanks a million for that advice - the guy at Fidelity just now has sorted me out to retract dissenting rights for 3000 sh, so I'll be joining the suit with 9000 shares (I needed the dough in case this drags on longer than we expect).
