Hello,
Its getting interesting. I have received confirmation of our case and OCATA is required to respond by June 23rd. We shall fight on. The Dumpster might come into play.

Kukkido I know its really none of my business, but I hope you guys keep posting as your case progresses. I am pulling for all of you to recoup your investment and a whole lot more. If nothing else, I hope you will post the final outcome when and if it comes to be while this forum is up and running. Fortunately I was able to get out with the Astellas deal with some profit and have no regrets even though I would have liked for OCATA to have gone all the way.

Even though I am out, I wish a huge success on your endeavor. I always thought in the current state it was worth at least a minimum of $12, but thought the $20's were realistic when we went deep into the phase II trials. Echoing this...I'm long gone, but wish you all the best. Give 'em hell!

What ever happened to all the short sellers? There were a ton of shares short. Anybody know? Whidbeygal, It was my understanding that all of the short sellers were to be "folded" into the new company, and go basically unaccounted for. If Ocata hadn't "sold out", the short sellers would have had to theoretically cover at some point in time and we would have seen the true nature of the "naked short selling" that helped destroy the investment. Please correct me if I am wrong. That scenario and the fact that it didn't seem to be of any concern to Astellas, as far as we know, raises speculation, at least in my mind, that there was foul play in driving the pps down. It seems to me to be the big heist where the crooks did get away to that island far away, with the money.....unfortunately, a lot of our money! I realize that this avenue won't be something that kukkido will have in his sights, but more of the value of the company's IP. I wish that it was something that kukkido was involved with, as I think that he would sink his teeth into it and not let go! doctor01

Kukkido Kukkido, I certainly have June 23rd marked on my calendar! I was just wondering if anyone had ever thought of what happened to the "Cowboy" and all of the other patients that had received "our cells" and had had good results. Weren't these people due to have continued monitoring for years to come? I am sure that they still must be on that program even if under the direction of Astellas. I am certain that, whatever the plans for Ocata were, that Astellas wouldn't want to lose the "paper trail" of time that these patients would provide. Wouldn't it be interesting to know what contact they have had with Astellas and if they were wishing to have their other eye injected??? Any value here Kukkido? doctor01

That scenario is wrong. All short sellers agree to cover per their brokerage agreement. There is no 'free lunch'----and the buyer of OCAT gave the long and short sellers plenty of time to sell or cover.

I just received a letter from the Covington Law firm that represents Ocata. They state Astella has settled with Aronson for $8.50 a share and an additional consideration of $1.95 for a total of $10.45 a share. They are offering to settle with other shareholders at this price, though they acknowledge the there are 8 other shareholders known as the Wortman petitioners who they have not settled with.
For the record in early/mid February 2016 I sold my shares to Astella for the $8.50 on the day oil settled below $30.00 a barrel and I plowed this money into oil companies MRO and CPE.
I will try to post the letters when I have time.

I haven't expected them to raise the offer, especially after the suspension of Ocata's trial (for details see the red bolded text here). BTW why did the law firm send you this letter if you have already sold your shares?

BTW why did the law firm send you this letter if you have already sold your shares? On the final day to notify the company of the intention to demand arbitration, I decided to arbitrate, so I looked up the name of a company on the same floor as Ocata and called the receptionist. I asked her if she knew anyone at Ocata, and I was told she often went to lunch with the receptionist at Ocata. I then asked her if I could email her a letter and would she hand deliver it for me. She did, so Ocata had me on record as a dissenter. A month or so later I reversed my decision and sold making a profit over my $5.15 average cost.
