in reading through the procedure again and again(legalize)i think they have goofed up already.as i understand it there is a requirement to make shareholders aware of available appraisal rights.btw you can still file!we did get enough crapp emails and phone calls.was this one too many?

I just posted this on the other site....was an interesting episode..... Let's hope everyone who has applied for appraisal can get together.....
"I checked our Scottrade account earlier this afternoon, and the full cash value of our Ocata stock was in our account and available to use. This was strange.....since we had applied for appraisal rights. I called Scottrade....waited while they checked, and then they thanked me for letting them know....certainly was a mistake!.....and said our paper stock certificate for our Ocata shares was being mailed overnight and we'd receive tomorrow. Checked later, and the dough is gone....but still shows the number of Ocata shares in the account (with 0 value). Maybe we should have taken the money and hit the trail.....!!"

astella paid of everyone,tender and non tender already.i wonder what they are going to do about appraisal rights?i guess it depends on the # of shares involved.it seems risk management at gabelli funds decided against filing.was that decision based on ocats value or on opportunities coming in a hugely oversold market?all their holdings were sold at 8.50 before the anouncement and might have taken astella over the top.prearranged?

vz..i think all the non tenders have been paid off as far as i know.they should have,by law,been made aware of their rights to an appraisal. that alpine filed and did not get paid chances are pretty good they are going for it. i think its 20 days from the closing that you can still file non tendered shares.by paying off quickly astellas seems to want to scare them off.starting off on the wrong foot astellas...this will not look good in court!

Hello folks,
I just spoke to Andersen Sleater, LLC law firm (Jessica Sleater and Eric Andersen) handling appraisals who was referred by Brandon Walker (one of the attorneys recommended on this site). They will be forwarding me a retainer letter that I can share with this forum if anyone else would like to join.
The cost summary is the following: this attorney firm gets paid 1/3 of the upside (so 1/3 of anything more they get over $8.50), there is about $400 out of pocket cost for filling and serving OCAT/Astella lawsuit papers which is divided by the amount of participants on the same filling. I will post the retainer document on this site (assuming I can) or forward it to whoever would like to join. Deadline for joining with this company will be February 26th.
Vzveteran, please chime in if you have a better deal with anyone else or if you want to reach out to these folks (maybe we can have them waive the out of pocket) so we align efforts if it makes sense. Sounds like the more people we get on one filling, the higher leverage we will have on negotiations and the lower the out of pocket cost.

Hi vzveteran, We'd like to join with a group to retain a law firm. Also, we just received our paper stock certificate from Scottrade, and the owner of the shares is listed as CEDE & CO....not our names??? Is this standard for everyone that is applying for appraisal? It seems that Cede & Co. is another story that no one understands!..... Thanks!
