No posts on NLST for over a year now. I started a position as IMO its worth having some $$$ here with the Samsung trial now having an imminent start date of 4/17/2023.
Things I like:
> The South Korean firm SK Hynix already settled with Netlist years ago for approximately $40M plus a licensing deal. That settlement took the pps from $2s to $10. > The Samsung, Micron and & Google patent infringement cases are based on the same Netlist technology but have just taken longer to move through the legal system. The wait is almost over with the Samsung trial starting 4/17/2023 and Micron (late 2023?) and Google (2024/2025) not too far afterwards.
> Based on Hynix settlement and technology used, settlements with Samsung (should be larger based on # of servers used), Micron and Google seem likely, IMO. > Based on pre-trial disclosures (see Reddit board) the number of years of patent infringement appears to be only question, IMO.
There are certainly risks, including that things drag out and any settlement doesn't meet market expectations.

Some consolidation anywhere near/over $2.50 will be a good sign. CEO interview from last year (link below) talks about the fact that Hynix already settled with Netlist (for violating the patents) and discusses the legal "hold out" that exists now, where pending legal action hasn't been concluded for all the other infringers of the same patents (Samsung, Micron, Google). The CEO is basically saying he expects the legal process to play out the same way where the "hold out" is eliminated after the remaining lawsuits are concluded. The legal system already weighed-in that Hynix was violating the patents. Some good recent consolidation at around $3.50. Some updates...
Pre-trial started yesterday (3/28) with some rulings in Netlist's favor by the judge, especially "willfullness". Samsung submitted a pre-trial motion claiming they were "not willfull" when they violated Netlists patents. The judge denied Samsung's motion, implying Samsung was indeed "willfull", thereby opening the door for triple damages if the case makes it to the one week jury trial starting April 17th.
IMO, the ruling on willfullness makes a settlement even more likely prior to 4/17, as Samsung would be taking a significant risk rolling the dice with triple damages on the table as a possible outcome.
If Samsung settles, Micron is highly likely to settle as well as that near-term upcoming trial is for the same patents with the same 2 judges (claim construction judge & trial judge).
A Samsung settlement will also likely remove the "stay" on the larger case with Google that goes back to 2009... and therefore will be larger in terms of damages Netlist will be seeking.

Nice $303M damages win in the courtroom today for Netlist against Samsung. With regard to the bolded in red above, Samsung took a huge risk by not settling before the jury trial. The jury ruled Samsung willfully infringed all 6 patents, setting things up for Judge Gilstrap to award increased (maybe treble) damages which could take the $303 million damages award much higher. Additionally, Samsung still doesn't have a license to use Netlist patents, so a licensing deal with recurring fees likely coming in the weeks/months ahead. I didn't realize NLST was recommended on this forum, but anyways I thought I'd add that I bought shares for the first time today. Looks promising, IMO.
Not a huge fan of IP/patent plays, but the risk/rewards here were more than palatable.
