i spoke to the registrars office at the chancelery court in delaware today and nothing has been filed so far. i found out who the lawyer is who is taking care of ocatas affairs.have a call in but no return yet.i get that a lot.good thing i am retired and have time for all this bs. fidelity told me i am on my own as far as splitting shares off is concerned.

I talked with Fidelity also. In my stock account I used the HELP number 800-544-6666...got me right to a trader. He would need more time to research splitting shares. As far as waiving dissenters rights, no charge, not a problem but you won't see the money in your account for "a few weeks". PIMA So if you have a hot stock that you feel would make more money than the Delaware route, hopefully it's hot in 3 or so weeks. I'm thinking Astellas may make a decent offer to dissenters as they may want to avoid paying a hell of a lot more in Delaware, plus 6% interest, plus legal fees. Approx 2.5mm shares is a lot of shares.

Hey everyone, I am back waiting to get our ducks in a row with the attorney. We have traveled so long so far and alot of the dissenters are waiting for the suit to get filed. What we need to do is get on board and group together so we can move forward. Obviously, if there is a hot stock and you want to withdraw your shares, that is your right. I am here to help the ones who will FIGHT ON. So, if you need anything PM me. I will be going to Korea til Sunday, so give me a day or so to reply. Things are moving along.

just to update my friends on here.i am in the process of withdrawing my petition for appraisal rights.its no easy feat and took a lot of research.i tried at first to split off some shares for a cash cushion in the 2 years it takes which was impossible. good luck to you all!

Sorry to lose you Churchmaus, How many shares did you have? Goodluck. Well, Needless to say, I just got back from Korea a day or so ago. I am moving forward and look for support from our Group. FYI, I met with CHA Biotech and was pleasantly surprised at the information they gave me concerning Blood and SCRIMI. I would venture to say our sale at 8.50 is nothing in comparison to what was discussed. Hold your ground and stay the course, we shall persevere.

12000 shares. the lack of participation on this thread and erics ridiculous demands have been a big part for me to make my decision to withdraw.the gag order and the demand for his clients to pay the cost of expert witnesses and appraisers,which can and will be substantial,out of our pockets before the outcome of the process is outrageous for taking a third of even the interest.i have talked to other lawyers familiar with appraisal cases and their advice was wait for the big boys to file and tag along.as long as you filed correctly and it gets accepted by the court you are a part and pay per share at the end.with 2.5 mill shares filed i am certain there are some big boys involved.only one party will represent all in court.will eric get picked or will he sit on his behind and collect?he does not seem to have any money to pay the costs either which is customery in his kind of arrangement. this is mhop and good luck to all again who can afford to do this!i can not.

Well,
I think we all understand what is going on. First, we had to get an attorney to take the case. All 10 attorney's I contacted said either the dollar amount wasn't great enough to take the case or they will charge by the hour. All of them said that expert fees and transcription costs are to be paid for by the clients. All the other fees will be paid for by the attorney such as filing fees and other court costs. If you found an attorney to pay for everything then they will want more on the contingency fees, I thought I did a great job of sourcing the attorney and getting the contingency fee down to 25%.
The risk was taken out with this case because we do not have to show we were damaged and all we have to do is file the case and prove our valuation. I guess you have three choices, 1.) Join the case sign the retainer, 2.) Sell you shares, 3.) Wait until the case gets filed and join. We all have different life situations that will dictate what we do, but the last post only means people won't want to go through the process or feel its not fair the attorney takes so much. Who else is going to look out for us, nobody works for free.
I am moving forward, we have enough shares to file the case, we are just looking for more people who we can help and keep informed. If you don't want to be apart that is okay, but please help us out and not poison our atmosphere with why you don't or can't be apart. We are trying to get our money back after all we have been through. After we file the case, we will request the shareholder list, at that point we will contact everyone and see if they want to join. If you feel inclined to do so great, if not, then you will have to hire your own attorney for an extra cost and then pay the fees of the suit plus additional fees. Its really not fair some of us bear the burden while others just sit and watch, up to you as we are here to add support.
I want to be first filer so we can control the case and its movement. I am not worried that we won't be selected as lead attorney because we have all the data and information needed to move the case forward quickly. I don't want to give up any of our strategies concerning the case that is why Eric and I thought it would be good not to give away information on the Forum. Once we file the case, we can be subpoenaed and have to turn over all Forum information. I think I'm just being careful, not trying to hide anything.
For those of us who have signed on already, know I just came back from Korea. The valuation of the blood patents alone are invaluable, no one had what we had, except for Astellas and they will pay, Royally. IMHO

Did you sell or request appraisal rights? I am trying to help those of us who have requested our appraisal rights as I have. It is the only way we are going to see what we are owed. Anyone can sell their shares but the remaining ones of us have to pool together and move the process forward. As I have explained, I just returned from Korea and when we file the petition we can get the information from CHA. I am telling you this because the valuation is far greater than what we were bought out for. So, we just have to keep moving forward.

...any knowledge of petition(s) having been filed to date with the Court of Chancery?
I wonder what happens to someones shares if they have not filed a petition correctly, or if they did not follow sub-sections a and d of appraisal rights, and the Court does not accept their petition. Do their shares just vaporize or do they receive the $8.50?
