nice work kukk! here is some additions. after the time to file has expired(60 days)astella has to give the court a list of dissenters.the court then checks the validity and we get a certified letter stating so. thats basically all you need to have to be part of the process as long as somebody files the lawsuit.if there are more the court will consolidate as only one is admitted.120 days to file but it can happen sooner. the court can also demand that stock certificates are deposited with its registrar but i hope this does not happen. you can withdraw shares within the 60 days.after that you can do so as well but it needs the courts approval.

We are making progress in getting all the information to make the best decision going forward....Please continue to Pm me your share count, as it may help in offering Astellas a settlement. Many Kudos to Kukkido for his yeoman's work! Amen on the Kudos to Kukkido. Here's what I don't understand. How/why would an attorney take a client for a 35% contingency fee if he doesn't know from the gitgo whether he'll receive his fee based upon anywhere between 10,000 & 2,000,000 shares. I would think that the amount of work an attorney would do if he thinks he'll get in the area of 35% x (P - $8.50) x 10,000 would be much less than if he believes his client base is closer to 1 or 2 million shares. BTW, P represents the final price per share either settled for or ruled by the Court.

Hey Everyone,
All this is great dialogue. We are on our way, I had a talk with the LA Attorney and Eric today. I fully understand the situation at this point. I have to wait until LA Attorney drafts his opinion with Eric's Opinion as this isn't as easy as it seems and look at the percentage of companies filing Appraisal Rights in the last year. Church is correct on his message, and Kingston, you are correct also. Let me get the letter tomorrow we will go from there. Remember, I have skin in the game also and am looking for a clear path forward. Some people didn't follow the Delaware rules and have already screwed themselves.
I will have a plan of attack tomorrow, if you all agree then we will start to move forward. If you want to be a sandbagger then sandbag, you will not have the support of the group. If and when the lawsuit is filed, only the people who will follow on will be privy to information. Or you can hire your own attorney. We, the People will prevail and as RODDY PIPER said, I have come here to chew bubblegum and kick ass...and I'm all out of bubblegum."
I see that someone named TedS on ICELL had started a fund to pay for some legal fees. Well, it would be nice if they would come over here to discuss this. Its not about Political Correctness now, its about--- Our livelihood.

not too much going on here either!today i got a copy of the letter fidelity/cede sent to ocata on my behalf asserting my appraisal rights. i dont know wether negotiating with astella will bring anything.as far as i am concerned we are way too far apart. as far as lawyering up for the chancery court we have time until may 10.there are a few questions i have after talking to eric andersen.he says he will get a third and costs of anything we get over 8.50.what about the 6% interest compounded per quarter or the reasonable lawyers fees the judge awards at the end of the show?i am not going for a lawyer after my shares get certified and hope the judge picks a good one to represent us all.eric calls me a freeloader but i will be happy to pay at the end on a per share basis distributed which averages 23% in previous cases for all.with eric probably taking 40% thats a 17% difference.with 100k$in play thats 17000$.if he does not get picked by the judge thats 40 grand for sitting on his behind.i have a sneaking suspicion there are arbitrage hedgefunds involved who will have their lawyers.
